H-1B: role, qualifications and current rules
H-1B concerns a specialty occupation and corresponding qualifications; actual duties matter as much as the title. The employer participates, while cap and registration rules depend on the case. Current visa-issuance and entry restrictions, possible exceptions and required expenses also need checking. An old account of a straightforward lottery is not a substitute for today’s legal assessment of the application and employer.
L-1: a transfer within a genuine international group
L-1 requires a qualifying relationship between the overseas and US organisations and qualifying employment. Generally, at least one continuous year of overseas employment during the preceding three years is examined, subject to applicable rules. Executive, managerial and specialised-knowledge roles are assessed substantively. Forming a US LLC alone is insufficient: genuine corporate relationships, operations and role evidence are needed, with new-office requirements reviewed separately.
Align the legal plan with the employer’s plans
Gather a role description, organisational structure, company information and employment records. Discuss the participants, employer-side documents, possible stages and limits on starting work. Entry, changes of status, extensions and family support should not be assumed to form one automatically inclusive service.
